relating to the packages sold by Coutances Tourisme

PART A: STANDARD INFORMATION FORM FOR PACKAGE TRAVEL CONTRACTS SOLD AT THE TOURIST OFFICE

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 II of the Tourism Code.

You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed in the Tourism Code. Coutances Tourisme will be fully responsible for the proper execution of the package as a whole.

In addition, as required by law, Coutances Tourisme has protection in order to refund your payments and, if transportation is included in the package, to ensure your repatriation in case it becomes insolvent.

Travelers will be provided with all essential information about the package prior to entering into the package travel contract.

The organizer as well as the retailer are responsible for the proper execution of all travel services included in the contract.

Travelers will be provided with an emergency telephone number or contact details to reach the organizer or retailer.

Travelers may transfer their package to another person, with reasonable notice and possibly subject to paying additional fees.

The package price may only be increased if specific costs increase (e.g., fuel prices) and if this possibility is explicitly provided for in the contract, and in any case may not be changed less than twenty days prior to the start of the package. If the price increase exceeds 8% of the package price, the traveler may withdraw from the contract. If the organizer reserves the right to increase the price, the traveler is entitled to a price reduction in the event of a reduction in the corresponding costs

Travelers may rescind the contract without paying rescission fees and be fully refunded the payments made if any of the essential elements of the package, other than the price, undergoes a significant change. If, prior to the start of the package, the professional responsible for the package cancels the package, travelers have the right to a refund and compensation, if applicable.

Travelers may resolve the contract without paying a resolution fee prior to the start of the package in the event of exceptional circumstances, such as if there are serious safety issues at the destination that are likely to affect the package.

In addition, travelers may, at any time prior to the start of the package, rescind the contract upon payment of an appropriate and justifiable rescission fee.

If, after the start of the package, important elements of the package cannot be provided as planned, appropriate alternative services shall be offered to travelers at no additional cost. Travelers may rescind the contract without paying a rescission fee when the services are not performed in accordance with the contract, this significantly disrupts the execution of the package and the organizer does not remedy the problem.

Travelers are also entitled to a price reduction and/or compensation in the event of non-performance or improper performance of travel services.

The organizer or retailer must provide assistance if the traveler is in difficulty.

If the organizer or retailer becomes insolvent, the amounts paid will be refunded. If the organizer or the retailer becomes insolvent after the beginning of the package and if the transportation is included in the package, the repatriation of the travelers is guaranteed. COUTANCES TOURISME has subscribed a protection against insolvency with AXA ASSURANCES COUTANCES. PART C: STANDARD INFORMATION FORM WHEN THE PACKAGE ORGANIZER TRANSMITS DATA TO ANOTHER PROFESSIONAL IN ACCORDANCE WITH ARTICLE L.211-2 II A 2° E) OF THE TOURISM CODE

If you conclude a contract with a partner provider of COUTANCES TOURISME within 24 hours after receiving the confirmation of the reservation from COUTANCES TOURISME, the travel service provided by COUTANCES TOURISME AND ITS PARTNER will constitute a package within the meaning of Directive (EU) 2015/2302 and Article L.211-2 of the Tourism Code.

As a consequence, you will benefit from all the rights granted by the European Union applicable to packages. COUTANCES TOURISME will be entirely responsible for the good execution of the package as a whole.

In addition, as required by law, COUTANCES TOURISME has a protection in order to refund your payments and, if the transportation is included in the package, to ensure your repatriation in case it becomes insolvent.

If, prior to the commencement of the service, the responsible professional cancels the service, travelers may obtain a refund and compensation, if applicable.

Travelers may rescind the contract without paying a rescission fee prior to the commencement of the service in the event of exceptional circumstances, such as if there are serious safety issues at the destination that are likely to affect the trip.

In addition, travelers may, at any time prior to the commencement of the trip, rescind the contract upon payment of an appropriate and justifiable rescission fee.

If, after the commencement of the trip, important elements of the trip cannot be provided as planned, appropriate alternative services shall be offered to the travelers at no additional cost. Travelers may rescind the contract without paying a rescission fee when the services are not performed as contracted, it significantly disrupts the performance of the trip, and the service provider fails to remedy the problem.

Travelers are also entitled to a price reduction and/or compensation in case of non-performance or poor performance of the travel service.

The service provider or retailer must provide assistance if the traveler is in trouble.

If the service provider or retailer becomes insolvent, the amounts paid will be refunded. COUTANCES TOURISME has subscribed a protection against insolvency with AXA ASSURANCES COUTANCES. The travelers can contact this organization if services are refused to them because of the insolvency of COUTANCES TOURISME. GENERAL CONDITIONS OF SALE

relating to the services of Coutances Tourisme

The authorized tourist offices, within the framework of the law of July 13, 1992, modified by the law N°2009-888 of July 22, 2009, can ensure the reservation and sale of all types of services, leisure and reception of general interest in their area of intervention. They facilitate the public’s approach by offering a choice of services. The tourist offices are local tourism organizations, made available to service providers and who have signed a mandate agreement with them.

These General Terms and Conditions of Sale (or “GTCs”) apply to contracts concluded between the “Customer” (or “the buyer”) and Coutances Tourisme (or “the seller”) managing the site www.tourisme-coutances.fr. The buyer can only proceed to a purchase from the seller or directly on his website if he is of legal age or authorized to sign contracts which engage his responsibility. The buyer will be financially responsible for all his uses of the said website. The services sold are reserved for individuals. Groups and professionals must contact the seller directly.

The vendor has taken out professional civil liability insurance with the company AXA ASSURANCES 4, rue de la Poissonnerie 50200 COUTANCES – tel: 02 33 45 04 28 – agence.rmslcoutances@axa.fr , in order to cover the consequences of the professional civil liability that it may incur in its capacity as a local tourism organization authorized to market tourism products.

Article 1. Purpose

The present conditions of sale aim to define the contractual relationship between Coutances Tourisme and the buyer and the conditions applicable to any purchase made through the website www.tourisme-coutances.fr. The acquisition of a product through the present site implies an unconditional acceptance by the buyer of the present conditions of sale, which the buyer acknowledges having read prior to his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site www.tourisme-coutances.fr is not directly related to his professional activity and is limited to a strictly personal use and on the other hand to have the full legal capacity, allowing him to commit himself under these general conditions of sale.

EPIC Coutances Tourisme retains the possibility of modifying at any time these conditions of sale, in order to respect any new regulation or with the aim of improving the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the buyer.

Article 2. Products

The products offered are those that appear on the website www.tourisme-coutances.fr in the store section or in the ticketing section of EPIC Coutances Tourisme, within the limit of available stocks.

EPIC Coutances Tourisme reserves the right to modify at any time the assortment of products. Each product is presented on the website in the form of a description of its main technical characteristics (size, capacity, use, composition, quantity… or in case of e-ticketing: description of the service, conditions, dates, times, etc…). The photographs are as accurate as possible but do not bind the Seller. The sale of products presented in the site www.tourisme-coutances.fr is intended for all buyers residing in countries that fully authorize the entry into their territory of these products.

In case of an order to a country other than metropolitan France, the buyer is the importer of the products concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums do not fall under the jurisdiction of the seller. They shall be borne by the buyer and are his responsibility both in terms of declarations and payments to the authorities and/or competent bodies of the buyer’s country. The buyer must inquire with his local authorities.

Article 3. Prices

The prices appearing on the product sheets of the internet catalog and are prices in Euros (€) including all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. EPIC Coutances Tourisme reserves the right to modify its prices at any time, it being understood that the price indicated in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order. In case of e-ticket purchase, shipping costs are not applicable as the e-tickets are directly sent by email to the buyer once the order is validated and paid.

Article 4. Order and payment terms

Before any order, the buyer has the possibility to create an account on the website www.boutique.tourisme-coutances.fr. The account creation section is accessible when one arrives at the validation of the basket of the first order. At each visit, the buyer, if he wishes to order or consult his account (status of orders, profile …), will have to identify himself using this information.

The buyer also has the possibility to make a quick order without creating a customer account. It will be advisable for the buyer to keep the reference of the order as well as the notification emails received to follow the package.

EPIC Coutances Tourism offers the buyer to order and pay for his products in several steps, with 1 single payment option:

– Secure payment by credit card (via the PAYZEN system): the buyer selects the products he wants to order in the “basket”, modifies if necessary (quantities, references…), checks the delivery address or fills in a new address. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method “Payment by Credit Card”.

The next step offers him to check all the information, take note and accept these general conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the button “Confirm my order”. Finally, the buyer is redirected to the PAYZEN secure interface in order to safely enter his personal credit card information. If the payment is accepted, the order is recorded and the contract is definitively formed. The payment by credit card is irrevocable.

In case of fraudulent use of the latter, the buyer may demand the cancellation of the payment by card, the sums paid will then be credited back or refunded. The responsibility of the bank card holder is not engaged if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or even 120 days if the contract binding him or her to the bank so provides. The amounts debited will be reimbursed by the bank within a maximum of one month after receipt of the Cardholder’s written objection. No costs for the return of the sums may be charged to the holder.

The confirmation of an order entails acceptance of these terms and conditions of sale, the recognition of having perfect knowledge of them and the waiver of its own terms and conditions of purchase. All the data provided and the recorded confirmation will be worth proof of the transaction. If the buyer has an e-mail address and if he/she has provided it on his/her order form, EPIC Coutances Tourisme will send him/her an e-mail confirming the registration of his/her order.

Article 5. Reservation of ownership

EPIC Coutances Tourisme retains full ownership of the products sold until full payment of the price, in principal, expenses and taxes included.

Article 6. Withdrawal

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of his order to exercise his right of withdrawal and thus return the product to the seller for exchange or refund without penalty, except for the return costs.

In accordance with Article L 121-21-8 3° and 12° of the Consumer Code, the provision of services of accommodation, catering or leisure activities that must be provided on a specific date or period are not subject to a right of withdrawal.

For reservations made online on the seller’s website www.tourisme-coutances.fr, the full price of the service will be required upon conclusion of the contract.

Any cancellation by the buyer will result in charges to be paid by the buyer.

The buyer may assign his contract to an assignee who meets the same conditions as he does to benefit from the service. In this case, the buyer is required to inform the seller of his decision by any means that allows for an acknowledgement of receipt (registered letter or e-mail with request for acknowledgement of receipt) no later than 7 days before the start of the service. The assignment of the contract must be made at cost price. The assignor and the assignee shall be jointly and severally liable to the seller for the payment of the balance of the price as well as any expenses incurred by this assignment.

Article 7. Delivery

Deliveries are made to the address indicated on the order form which can only be within the agreed geographical area. Deliveries of orders are made by La Poste via COLISSIMO for objects, delivery service with tracking, handover without signature. Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. EPIC Coutances Tourisme will be able to provide the buyer with the tracking number of his package by e-mail. The buyer will be delivered to his home by his letter carrier or will receive an e-ticket by e-mail in the case of an online ticket purchase. In case of absence of the buyer, he will receive a notice of passage of his factor, which allows him to withdraw the ordered products at the nearest post office, during a time indicated by the postal services. The risks linked to the transport are at the charge of the buyer from the moment the articles leave the premises of EPIC Coutances Tourisme. The buyer is required to verify in the presence of the employee of the Post Office or the deliveryman, the state of the packaging of the goods and its contents upon delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.

The seller is obliged to take back a product in the event of delivery that does not conform to the order or is defective.

The buyer must return the product in its original packaging, indicating the reason for refusal on the delivery note or invoice, the costs being borne by the seller, and may demand either a new delivery respecting the order, or the exchange of the product by another similar one, or the cancellation of the order (with reimbursement of the sums paid).

Article 8. Warranty

All products supplied by EPIC Coutances Tourisme benefit from the legal warranty provided for by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it can be returned to EPIC Coutances Tourisme which will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by post to the following address Coutances Tourisme – 6 rue Milon – 50200 Coutances within thirty days after delivery.

Article 9. Responsibility

EPIC Coutances Tourisme in the process of distance selling, is only held by an obligation of means. Its responsibility cannot be engaged for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, break in service, or other involuntary problems.

Article 10. Intellectual Property

The photos, maps, and illustrations contained in the brochures and/or the website are illustrative and are not contractual. All elements of the www.tourisme-coutances.fr website are and remain the exclusive intellectual property of EPIC Coutances Tourisme. Any reproduction or commercial or non-commercial exploitation of these elements is strictly forbidden without prior written authorization.

It is also forbidden to repeatedly and systematically extract protected or unprotected elements from the site www.tourisme-coutances.fr causing any prejudice whatsoever to EPIC Coutances Tourisme or to one of its service providers or suppliers.

SPECIAL CONDITIONS OF SALE

Preamble

In accordance with Article L211-8 of the Tourism Code, the present special conditions of sale are intended to inform the customers of Coutances Tourisme, which may be referred to hereinafter as “the reservation service”, registered in the register of travel and stay operators under the n°IM050150001, prior to the reservation of accommodation, ticketing, stays or packages. In accordance with Article L211-9 of the Tourism Code, Coutances Tourisme reserves the right to make changes to these special conditions of sale, in which case this information will be brought to the attention of the interested parties in writing before the conclusion of the contract.

The customer or beneficiary refers to the holder of the service entitling him/her to a stay or an activity on the territory of the community Coutances mer et bocage during the year 2021.

Any reservation validated on the website www.tourisme-coutances.fr, implies the unreserved acceptance of the provisions of these special conditions of sale (CPV).

These conditions of sale are applicable to the booking of services such as ticketing, accommodation, packages and “boutique” products of the online store of the website www.tourisme-coutances.fr.

Article 1: Conditions of subscription

The customer must be at least 18 years old, legally capable of contracting and not under guardianship. Consequently, Coutances Tourisme cannot be held responsible in the event that, an unaccompanied minor would have subscribed, without his knowledge, to a reservation of ticketing, accommodation or any other tourist service.

Reservations are recorded:

Either by internet on the website tourisme-coutances.fr, in this case, the reservation form cannot be validated without the box “I have read and accept the general and special conditions of sale” being ticked,
Or by telephone on 02 33 19 08 10,
Or at the counter of the Coutances Tourisme Tourist Information Offices.
To be validated, all reservations must be paid in full (by credit card, cheque made out to Régie Coutances Tourisme, Holiday Cheques or cash).

Orders of “boutique” products are made by internet on the website www.tourisme-coutances.fr, in this case, the order form cannot be validated without the box “I have read and accept the general and special conditions of sale” being checked.

Article 2 : Booking validation

Any ticketing booking request by phone will be subject to an option that can only be validated at the time of payment on the part of the customer, before the deadline that will be indicated to him.

Reservations for any other tourist or counter service must be validated in writing (either by email or by mail). Otherwise it will be considered as non-validated by the customer, who will not be able to claim any refund or compensation.

Similarly, in case of non-appearance of the beneficiary on the dates agreed upon at the time of the reservation, the services are considered as cancelled due to the beneficiary who cannot claim any refund or compensation.

In the event of non-use, the beneficiary may not claim any refund or compensation of any kind.

Article 3: Validity of offers

The services subject to these terms of sale are valid for the year 2021.

The tourist services are offered according to the opening dates, subject to the availability of the service providers at the time of the booking request by the beneficiary.

Article 4 : Content of the services

The content of the tourist services is specified on our commercial leaflets and our website www.tourisme-coutances.fr.

Article 5 : Duration of the services

The duration of each service is that indicated on our commercial leaflets and on the website www.tourisme-coutances.fr. Given its specific nature, it can in no case be extended after the due date specified in the contract. For the good realization of certain services, the customer must appear on the specified day and at the times mentioned or contact the provider directly in case of delay. In the case of a reservation of an accommodation, the beneficiary must inform the owner directly of his arrival time. If the client does not inform the owner of his arrival time, the reservation is not guaranteed after 6:00 pm. Some establishments do not have night reception, it is essential for the client to take precautions.

For the ticketing, the times and places of meeting indicated are to be respected in order to guarantee the smooth running of the service.

Article 6 : Reservation and delivery of documents and/or items

The reservation of service is considered firm and definitive as of its confirmation translated by the delivery of a voucher in person and/or by email and/or by mail mentioning the date of realization, the nature of the service, the amount, the place of the stay and / or the activity. This voucher is to be presented to each service provider concerned upon arrival.

For any order of “boutique” products validated on the Coutances Tourisme website, the customer will receive a confirmation e-mail. The products are offered within the limits of available stocks. In case of unavailability, the customer will be informed.

The “boutique” products are shipped via the services of the Post Office to the delivery address indicated during the validation of the order. Shipping costs are at the customer’s expense. Coutances Tourisme cannot be held responsible in case of loss or damage of the products during the delivery. Any delay in delivery must be indicated to Coutances Tourisme within a maximum of 21 working days after shipment, in order to open an investigation.

If the carrier confirms the loss of the article, Coutances Tourisme undertakes to send back an identical product (shipping costs offered) or to reimburse the ordered article upon request. If the item is no longer available, Coutances Tourisme will refund the item.

Article 7: Price

The prices charged are rates in euros including VAT.

For accommodation services, the tourist tax is payable with our services at the time of booking in accordance with the deliberation in force. All information regarding the tourist tax is available on the website: https://coutancesmeretbocage.taxesejour.fr/

The prices shown on the website and our commercial brochures may be modified at any time, without prior notice, it being understood that such modifications will be inapplicable to previously accepted reservations.

The prices do not include transportation and expenses of a personal nature.

The price of “boutique” products displayed on the website www.tourisme-coutances.fr does not include shipping costs. These costs are to be paid by the customer and are communicated before the order is finalized.

Article 8: Insurance

The products offered by Coutances Tourisme do not include any cancellation and repatriation insurance. The customer may subscribe if he wishes to an insurance service with the organization of his choice.

Article 9: Withdrawal

The right of withdrawal of 14 days does not apply to the services of accommodation, transport, ticketing and catering (see Article L121-20-4 of the Consumer Code).

However, it does apply for orders of “boutique” products. The customer may, in this case, return the item without justification within 14 days after receipt, the shipping costs will in this case, at his expense.

Article 10: Modification

Due to the customer:
Any modification of a reservation by the customer must be reported either by phone to 02 33 19 08 10 or by email to accueil@tourisme-coutances.fr. It is then submitted to Coutances Tourisme for validation, with adjustments to the rates or services if necessary.

As a result of Coutances Tourisme:
The services sold by Coutances Tourisme may have to change during the period of their validity and this for reasons of quality of services or impossibility of providing one or more services (closure, transfer of an establishment, absence of a provider, weather …). In this case, the beneficiary will be informed of this modification at the time of his reservation request or as soon as Coutances Tourisme is aware of it and will then be offered substitute services whose value will be at least equivalent to the service initially proposed. In the event of an accepted modification, the client will not be entitled to a refund of the offer nor to compensation of any value whatsoever. In this case, the customer will receive a new voucher. If Coutances Tourisme is unable to propose an alternative solution, the customer will be reimbursed the amount of the service booked without penalty; the customer will then be unable to claim compensation of any value whatsoever.

Article 11: Obligation to inform the customer

The customer must inform Coutances Tourisme, in writing, prior to any reservation, of any particularity concerning him/her and likely to affect the stay (person with reduced mobility, with or without wheelchair, presence of an animal, etc…).

Article 12: Contract assignment

The client may assign his reservation contract to a third party, who meets the same conditions as him as long as this contract has not produced any effect. In this case, the client must contact Coutances Tourisme, in writing, either by email at accueil@tourisme-coutances.fr, or by mail. Coutances Tourisme will validate the new reservation request, as far as possible, by written return.

Article 13: Cancellation

13-1 Cancellation due to Coutances Tourisme
In the case of a cancellation due to Coutances Tourisme or its service provider, Coutances Tourisme must inform the client by any means as soon as possible. The customer, without prejudice to any recourse for compensation for any damage suffered, will be reimbursed without penalty of the amounts paid. These provisions do not apply when an amicable agreement is reached with the purpose of acceptance by the customer of another service offered by Coutances Tourism.

It may happen that certain proposed activities are cancelled if events beyond its control impose themselves on Coutances Tourisme or one of its service providers, i.e. the occurrence of an event that Coutances Tourisme had not had the possibility to foresee, which will be beyond its control and unable to overcome despite its diligence and efforts to resist it; or due to the behavior of a third party to the contract shall in any case not result in any compensation to the benefit of the user by Coutances Tourisme.

13-2 Cancellation due to the client
All cancellation requests must clearly state the reservation number, name and contact details of the persons concerned by the cancellation. Any request for cancellation will be retained only on declaration made imperatively by mail or email to Coutances Tourism and not to the tourism providers directly.

The fees retained from the client are as follows for services including an accommodation service:

Cancellation more than 30 days from the stay: 50% fee,
Cancellation at 30 days and less than 30 days: 100% fee.
As for the tickets, they are neither exchanged nor reimbursed, except for certain exceptions after agreement of the concerned provider.

Article 14: Visuals

The photos, maps and illustrations contained in the brochures and/or the website are illustrative and are not contractual.

Article 15: Claim

These particular conditions of sale are subject to French law. Any complaint relating to a service must be sent by mail and/or email to Coutances Tourisme, within 8 days following the date of the service.

After having referred the matter to the quality department and failing a satisfactory response within 45 days, the client may refer the matter to the tourism mediator, whose contact details are available on the website www.mtv.travel.

PROTECTION OF PERSONAL DATA

Article 1. Collected data

In the context of its activity cited in the present general conditions of sale, Coutances Tourisme implements and operates personal data processing. As such, the Tourist Office collects the following personal data and variable according to the activities/services offered: first name, last name, title, date of birth, postal address, email address, telephone number, payment methods.

Article 2. Purpose

The collection of these personal data is essential for the contractual execution and in case of refusal to communicate them, no service can be performed. This personal data is collected for the exclusive purpose of ensuring the management of the requests of the persons in the context of the conclusion of the contract and its execution.

Article 3. Persons authorized to access the data

The persons authorized to access the data collected within the Tourist Office are the employees of the Tourist Office and its partners involved in the services requested, and where appropriate, the subcontracted service providers of the Tourist Office involved in the realization and / or administration of services.

Article 4. Conservation of data

These personal data collected are kept for the legal conservation period relating to the purpose of the processing and at the latest for a period of five years. The personal data relating to the Customer’s bank card are kept exclusively for the time necessary for the completion of the transaction at by the banking organization with which Coutances Tourisme works.

The Tourist Office implements organizational, technical, software and physical measures in terms of digital security to protect personal data from alteration, destruction and unauthorized access. However, it should be noted that the Internet is not a completely secure environment and the Tourist Office cannot guarantee the security of the transmission or storage of information on the Internet.

Article 5. Rights of the holder of the data collected

Each customer has a right to access, modify, rectify and permanently oppose personal data concerning him/her. To make use of this right, he/she just needs to contact the DPO of Coutances Tourisme – 6 rue Milon – 50200 COUTANCES or by email at: mes-donnees@tourisme-coutances.fr

At any time, the Customer can lodge a complaint with the CNIL according to the modalities indicated on its website (https://www.cnil/fr)
